Activity Synopsis (ID# 31808) (Hide Synopsis)

Objective(s) to further improve the legal framework on asset recovery in cooperation with relevant partner institutions
Output/Results Following the Council of Europe/CAR project initiative, the Serbian Ministry of Justice established a Working Group assigned to amend the Law on Seizure and Confiscation of the Proceeds from Crime. Despite a number of legal analysis and comparative studies prepared by the project a slow progress in the amendments drafting have been made by the Working Group. In order to speed up the process, and with the consent of the Deputy Minister of Justice, a team of national experts and CAR project consultants will prepare the draft amendments for the attention of the Working Group. The same applies to the follow up drafting process for the by-laws regulating the work of the Directorate for Management of Seized and Confiscated Assets (DMSCA) and the operations of the Financial Investigation Unit (FIU) of the Ministry of Interior.
Conclusions/Follow Up the legislative review will continue in 2012 aiming at finalisation of the amendments to the Law on Seizure and Confiscation of the Proceeds from Crime.
