Title Expert assessment of the draft Code of Ethics for Prosecutors and participation to a round table meeting to discuss the draft 
Description The purpose is to provide recommendations on the new Code of Ethics for Prosecutors, drawn up in the framework of the on-going reform of the PPS.

This assistance has been requested in a letter of the Prosecutor General of the Republic of Moldova of 28.02.2011 and is in line with objectives under Component 1 of the Democracy Support Programme.

The written assessment will be provided by the CoE consultant Mr Jorge Dias Duarte, prosecutor, Portugal.

Objective(s) At the request of the Prosecutor General of the Republic of Moldova, the programme provided recommendations on the new Code of Ethics for Prosecutors, in the framework of the on-going reform of the PPS. 
Output/Results The written assessment was drawn up by Mr Jorge Dias Duarte, prosecutor from Portugal. The representatives of the Directorate General of Human Rights and Legal Affairs participated to the round table discussions on the draft Code of Ethics on 1 April 2011. 
Conclusions/Follow Up As a result of the above mentioned activities, the draft Code was substantially improved by its authors and its revised version was submitted to the programme for further consultations. Despite notable improvement of the draft after the first round of consultations, there are several important recommendations which have not been fully acknowledged. It is of utmost importance to exclude from the Code those provisions that can be interpreted and applied in the sense of restricting arbitrarily fundamental human rights (for ex.: freedom of speech; the right to privacy etc.). President of the Superior Council of Prosecutors, the authority which is supposed to adopt the act, requested further assistance on the fine-tuning of the draft Code in accordance with the Council of Europe recommendations of judicial ethics. Such an activity, intended to produce the final version of the Code, will be carried out by the programme in July 2011.
