    Project Purpose 4      2015/DG I/JP/3195   Strengthening the efficiency of justice and support to lawyers’ profession in the Republic of Moldova 1 400 000 
    (51 Activities) Narrative
    Component 1: “Strengthening the efficiency of the judicial system in the Republic of Moldova”
    Component 2: “Support to the Moldovan Bar Association (MBA)”:

    Improve the quality of the profession of lawyer (advocate):
    - Strengthen the Moldovan Bar
    Association (MBA) including as regards its role in recruitment, training and disciplinary proceedings;
    - Strengthen national training institution of legal professionals.
    By the end of the project the efficiency and quality of the selected pilot courts are significantly improved which is reflected in the results of the court user satisfaction surveys and assessments of the CEPEJ.


    The MBA is able to represent the interests of its members and to provide a credible counterpart to organisations representing other groups of legal professionals at national level. European standards and the recommendations of relevant CoE bodies concerning the mandate and functioning of Bar Associations are addressed and applied in the Republic of Moldova.

    The quality of the judges/lawyers training is enhanced, applying systematic course accreditation and modern technologies
     
    - CoE and EU Monitoring Reports on the Republic of Moldova;

    - NGO monitoring reports;
    - Reports of the relevant judicial organisations;
    - Media reports;
    - Meeting and mission reports;
    - Expert reports with recommendations;

    Political stability in the country. No significant reshuffling of high level officials and responsible state asnd judicial bodies occurs during the implementation period. The authorities maintain the focus on the implementation of the CoE Action Plan and other country strategic documents with regard to the justice reform; the reform will continue and the means necessary for their implementation will be maintained. 
    Expected Result 4.1 The capacity of the Superior Council of Magistracy (SCM) and other national authorities in assessing the efficiency of the justice system is strengthened.
    Capacity of the judicial authorities to implement efficiency and quality monitoring of courts is provided through assistance in drawing up relevant procedures and amendments to the legal framework; awareness raising activities and at least two training sessions for the members of the SCM are organised.

    - Internal and annual reports of the SCM, MoJ and other releant judicial bodies;
    - Results of the evaluations and assessments conducted by the SCM are prepared on the basis of the CEPEJ guidelines and methodology;
    - Legislation and regulations of the Republic of Moldova concerning management and efficiency of courts;
    - Statements of the Moldovan officials and representatives of the SCM and judiciary;
    - CEPEJ reports;
    - Reports of national and international organisations;
    - Media coverage and reports;
    - Meeting and Mission reports.
     
    The SCM and relevant authorities prioritise improving court efficiency and quality.
    Expected Result 4.2 The length of the proceedings decreases, the clearance rate improves and the disposition time is shortened in pilot courts through the application of the methodology and tools developed by the European Commission for the Efficiency of Justice (CEPEJ) on judicial time management and quality of judicial services (e.g. SATURN Guidelines on Judicial Time Management; Handbook for Conducting Satisfaction Surveys, Checklist on the Quality of Justice and the Courts, etc.).
    The clearance rates reach at least 100% and the disposition time decrease by at least 20% in the pilot courts at the end of the project, after having followed CEPEJ guidelines and against the baseline of the previous assessment reports prepared within the framework of the Eastern Partnership project.
    At least 70% of respondents to satisfaction surveys note improvements of quality policies in the pilot courts.

    The SCM and relevant authorities prioritise improving court efficiency and quality. The judicial authorities have necessary resources (financial or human) to implement further cascading of the results of the pilot courts in other courts of the Republic of Moldova. Judicial community is actively engaged in the policy discussions. They support the SCM and other authorities in implementation of the measures for improving the efficiency and quality of justice system.
    Expected Result 4.3 An action plan for the dissemination of the results of the pilot phase, as well as for the preparation and adoption of relevant legislative and policy norms for efficient court work are drawn up and approved by judicial and governmental authorities.
    The next justice reform strategy and action plan include the action plan for the dissemination of the CEPEJ tools and guidelines nationwide, based on the lessons learned through the pilot phase.

    The SCM and relevant authorities prioritise improving court efficiency and quality. The judicial authorities have necessary resources (financial or human) to implement further cascading of the results of the pilot courts in other courts of the Republic of Moldova. Judicial community is actively engaged in the policy discussions. They support the SCM and other authorities in implementation of the measures for improving the efficiency and quality of justice system.
    Expected Result 4.4 NIJ uses the CEPEJ tools and guidelines on efficiency and quality of justice in their initial and continuous trainings for judges.

    Teaching on the CEPEJ tools and guidelines becomes integral part of the curriculum of the NIJ.

    ToT module is developed for the trainers and the NIJ has a pool of the trainers available to furtehr cascade the training within the timeframes of the project implementation.

    At least 70 % of the future trainers of the NIJ claim to be satisfied or highly satisfied by the training provided.

    - Reports produced by the NIJ and the SCM;
    - Reports of other stakeholders and international organisations active in the justice sector;
    - Curricula and training programmes of the NIJ;
    - Feedback from the trainers and trainees of the NIJ;
    - Evaluation of the trainings and questionnaires;
    - Reports of national and international organisations;

    - Meeting and Mission reports.
     
    Relevant financial and human resources are available for the implementation of the new courses and further promotion of new training methods at the NIJ.
    Expected Result 4.5 Increased compliance of national legislations and regulation relating to the mandate and functioning of the Moldovan Bar Association (MBA) with European standards and CoE recommendations.
    European standards and the recommendations of relevant CoE bodies concerning the mandate and functioning of Bar Associations applied to a large extent in the Republic of Moldova;

    - Mission and meeting reports;
    - Experts' report with recommendations;
    - Draft legislative amendments;
    - Media coverage of public discussions on legislative initiatives;
    - Reports of other national and international organisations working in the Republic of Moldova;
    - Project narrative and final reports.
     
    - Political will for reforms in the field relating to the project;
    - The existing legal gaps are acknowledged by the authorities and they are ready to undertake measures to develop legislation, regulatgions and to alter existing practices;
    - Availability of the necessary financial and other resources;
    - Availability of experts.
    Expected Result 4.6 The regulatory framework of the MBA (including ethical and disciplinary rules) is developed in line with European standards;
    Increased compliance of the MBA regulatory framework (including ethical and disciplinary rules) with European standards. Better capacity of the MBA to perform its functions effectively;

    - Experts' report with recommendations;
    - Draft legislative amendments;
    - Reports of other national and international organisations working in the Republic of Moldova.
     
    - The MBA is fully engaged in the project implementation;

    Expected Result 4.7 Strengthened capacity of the MBA management and staff to apply management techniques.
    The leadership and staff of the MBA is able to apply modern management techniques at least in the following three areas: strategic planning, financial planning, and communications;

    - Assessment forms of training events;
    - Reports of other national and international organisations working in the Republic of Moldova.
     
    - The MBA is fully engaged in the project implementation;
    - Availability of the MBA staff and their willingness to participate in training activities, as well as to apply the new skills acquired in the working process;
    - Availability of the necessary financial and other resources;
    - Availability of experts.
    Expected Result 4.8 Increased skills and knowledge of lawyers through the development of curricula for continuous training courses and the use on the Online Teaching Platform.
    At least 50% of training modules are revised in line with the needs of lawyers and are in accordance with European standards;

    The pool of MBA local trainers is strengthened as to satisfy the needs of the continuous professional training process of lawyers;

    Expected Result 4.9 Provisions of the national legislation and regulations related to the selection criteria for membership of the Advocates Licensing Commission and its functioning are in line with European standards.
    Modernised procedure of selection criteria for membership of the Advocates Licensing Commission capable of ensuring that the process is open and transparent is applied;

    Expected Result 4.10 Compliance of national disciplinary proceedings against lawyers with European standards and CoE recommendations largely increased.
    Improved disciplinary procedures for the lawyers are established. The Commission for Ethics and Discipline functions in an efficient and timely manner. The quality of the decisions of the Commission is improved;
