    Overall Objectives The overall objective of this Project is to bring Kazakhstan’s criminal justice framework and institutional practice in line with European and international standards and practices by supporting the country’s authorities in their efforts to improve the justice system in the medium and long term.

    Legislative acts and regulations related to criminal proceedings are amended to reach compliance with European and international standards.

    The application of the new Criminal Code (CC) and Criminal Procedure Code (CPC) is ensured in a manner compatible with the fair trial requirements for adversarial proceedings, publicity, and impartiality.

    The capacity of judges, prosecutors, investigators, defence lawyers, Commissioner for Human Rights, National Preventive Mechanism and other actors of the criminal justice system to apply European and international standards in their daily work is strengthened.
     

    Analysis of relevant legislation.

    Assessments of the situation as regards access to justice and legal protection by national and international organisations.

    Reports from the branches of the judiciary and judicial institutions, as well Commissioner for Human Rights reports.

    Press and NGOs coverage.

    Statistical data from the training institutions and professional associations.

    Reporting under the project.
     

    Full political commitment and engagement by the partners.

    The beneficiaries will seek to maintain a continuous and smooth level of co-operation and will provide the required level of participation in the project activities during the whole implementation phase.

    Criminal proceedings and trials are based on human rights standards
    The recommendations drawing from CoE assessments in the field of criminal law and procedure are included in the draft legislation.

    Amendments addressing the co-operation between prosecutors and lawyers, and the impartiality of judges, are formulated.

    Expected Result 0.1 Criminal proceedings and trials are based on fair trial requirements for adversarial proceedings, publicity, and impartiality.
    Analysis is provided for the procedural rules on pre-trial disclosure of all relevant material and evidence to the prosecutor and defence lawyer to allow the prosecutor and defence lawyer to summon all relevant witnesses and be able to examine each other’s witnesses on equal terms.
    Recommendations made for the powers of the public prosecutor and defence lawyers to be in line with European and international standards.

    Regulatory amendments proposed to ensure that trials are held in public.

    Policy and legislative support as well as analysis provided on the principles of independence and impartiality in conduct of criminal trials.

    Expected Result 0.2 Protection and promotion of human rights and fundamental freedoms in criminal justice system expanded / Criminal proceedings are open to public scrutiny. Judges, prosecutors and defence lawyers acquire fair trial skills
    Participating judges, prosecutors and defence lawyers in training activities display an improvement in their knowledge and ability to apply the general principles enshrined in international agreements in the field of criminal law and the requirements of a fair trial.

    Following the implementation of the CoE experts’ recommendations, trial monitoring mechanisms show an improved respect for fair trial principles.

    As a result of the output of the project, practitioners and the public increase their awareness of the conduct and outcome of criminal proceedings and trials.
