    To contribute to the role of the judiciary in Turkey in implementing the new normative framework in line with the acquis, the rights and freedoms guaranteed by the ECHR, the provisions of the ESC and other European standards shared by the EC and the CoE through their interpretative decisions.

     

     

     
    Project Purpose 1      2015/DG I/JP/3396   Supporting the Individual Application to the Constitutional Court in Turkey 6 382 228 
    To contribute to supporting and strengthening the individual application system in Turkey by empowering the judiciary in Turkey in line with the acquis, the rights and freedoms guaranteed under the system of the ECHR. Indicator 1: Capacity of TCC to handle IAs developed
    Indicator 2: Applications from Turkey for substantial cases before the ECtHR are reduced
    Indicator 3: Number of cases before the TCC leading to legislative amendments;
    Indicator 4: Number of cases closed by the Commission in charge of length of proceedings.

    Expected Result 1.1 The rights and freedoms set forth in the Turkish Constitution and the ECHR are better secured at the national level
    Indicator 1.1: Meaningful reduction of the number of applications to the ECHR at the end of the project compared to the number of applications before the start of the project;
    Indicator 1.2: Increase in the admissibility decisions of the CC compared to the total number of individual applications brought before the CC;
    Indicator 1.3: Increase in changes of the case law of Turkish high courts in line with international and European human rights standards, and in line with the CC’s case law;
    Indicator 1.4: Number of the inadmissibility decisions of the ECHR at the end of the project compared to the no of decisions before the start of the project

     Stakeholders’ dedication to participate and cooperate throughout the process;
     Continued commitment to the EU accession process and to the political and judicial reform agenda;
     Ministries and other relevant public institutions lend high level support for the projects
     Adequate structures to monitor the progress are established and functioning within each partner institution;
     The capacity of partner institutions are adequate to support the Action via human and technical resources.
    Expected Result 1.2 Capacity of the judges, prosecutors and lawyers in Turkey on the individual application mechanism and implementation of fundamental rights protected by the ECHR is increased
    Indicator 2.1: Significant changes of the case law of the first instance courts and high courts in line with the Convention, Constitution of Turkey and the case law of the ECtHR;
    Indicator 2.2: Proportional decrease in the number of individual applications that are declared inadmissible on the grounds of “fourth instance” prohibition;
    Indicator 2.3: Knowledge level of the judges, prosecutors and lawyers about individual application proceedings and fundamental rights protected by the Turkish Constitution and ECHR;

     Partner institutions are able to provide adequate staff/members and other resources for implementation;
     Relevant data available from beneficiary institutions;
     Adequate supply of expertise by peer institutions from other EU countries;
     Trainers are selected according to established criteria and show skills necessary for the training activities.
    Expected Result 1.3 The co-operation of the Turkish Constitutional court and other high courts with their European counterparts increased.
    Indicator 3.1: Number of cooperation activities carried out before and during the Action.
    Indicator 3.2: Number of new practices/amended rules implemented within TCC and other high courts after exchanges with other European counterparts.

     Readiness of the Beneficiaries to cooperate and establish regular mechanisms for international cooperation;

    Expected Result 1.4 Awareness of Turkish public on the individual application mechanism to the Constitutional Court and implementation of fundamental rights increased
    Indicator 4.1: Number of brochures prepared, published and distributed;
    Indicator 4.2: Articles, news and TV programmes on national / local/ international mass media;
    Indicator 4.3: Number of hits and download from the website of the Action;
    Indicators 4.4: Surveys/opinion polls carried out at the beginning and at the end of the project (comparative basis: same representative samples).
