    To contribute to the enhancement of the judicary in accordance with European standards and to thereby increase public trust in the judiciary of Turkey

     

     

     
    Project Purpose 1      2015/DG I/JP/3139   Strengthening Judicial Ethics in Turkey 3 711 111 
    To promote judicial ethics in Turkey and to ensure effective implementation of the Code of judicial ethics and to raise awareness amongst judges, public prosecutors, lawyers and members of the public on the matter with a view to allowing an enhanced public scrutiny. The Code of Judicial Ethics incorporated in law or procedures regulating to promote judicial integrity through education and training programs, judicial mentoring and counselling, citizen complaint procedures, and investigative and disciplinary mechanisms as documented in increased numbers of references to the Code in their decisions and reports by the High Council of Judges and Prosecutors (HCJP) and the Inspection Board.  EU Commission's:

    Expected Result 1.1 A detailed analysis of the situation in the field of judicial ethics is made and a Code is developed.
    Increase in the number of decisions and reports made reference to the code of judicial ethics by the High Council of Judges and Prosecutors (HCJP) and the Inspection Board.

    Permission by High Council for Judges and Prosecutors for participation of judges and prosecutors in project interventions, training of trainers and cascaded training sessions and other programmes.
    Expected Result 1.2 Awareness of the Turkish judges and prosecutors on judicial ethics increased.
    Judges and prosecutors made reference to the Ethic Code in their petitions on requests, complaints, defence and appeals against the decisions of the HCJP.

    Cases where sanctions are imposed by the HCJP in ethics-related complaints are decreased between 10% in two years before the end of the project compared to the baseline data to be collected under activity.

    Current elements in the curricula of the Turkish Justice Academy on ethics are revised and 1 new course dedicated to judicial ethics is introduced.

    Expected Result 1.3 Capacity of the High Council of Judges and Prosecutors (HCJP) to implement the Code is enhanced.
    The HCJP and the Inspection Board set up the complaints procedure including the procedure for administration, investigation and decision making for disciplinary measures are open and transparent.

    Length of ethics-related disciplinary investigations is shortened by 10% in two years before the end of the project compared to the baseline data to be collected.

    CoE, EU and peer-based mission reports.
     
    Active involvement of stakeholders.
    Expected Result 1.4 Public awareness on judicial ethics and the availability of complaint mechanisms increased.
    Increase number in citizens made reference to the Code in their applications as an effective method of disciplining members of the judiciary who fail to adhere to the principles as promulgated with respect of the judiciary.

    At least 3 national newspapers cover the developments on a large scale. At least 5 articles of a scientific nature are published concerning the introduction of the new Code of Ethics.
