    Project Purpose 1      2015/DG I/JP/3193   Support to increased efficiency of courts, improved training of judges and judicial self-governance in Azerbaijan 1 500 000 
    To enhance and support the implementation of the reform of judiciary in Azerbaijan in line with CoE standards. Recommendations and findings of the CoE bodies – Venice Commission, ECtHR, Office of the Commissioner of Human Rights, European Commission for the Efficiency of Justice (CEPEJ), Consultative Council of European Judges (CCJE), and recommendations of the project ''Enhancing judicial reform in Eastern Partnership countries''– are addressed through the roadmap for implementation of the reforms, draft laws and secondary legislation.
    By the end of the project three aspects of the functioning of judiciary: self-governance, efficiency, and judicial training are reviewed and reflect the CoE standards and recommendations.

    CoE and EU Monitoring Reports on the Azerbaijan; CoE Human Rights Commissioner’s reports; recommendations of the project ''Enhancing judicial reform in Eastern Partnership countries;'' reports of other international organisations.  Political stability in the country; the beneficiary institutions are committed to implement the reform in their respective institutions; ownership and engagement of the beneficiary institutions in the reform process remains high. 
    Expected Result 1.1 The efficiency and quality of judicial services in five pilot courts are improved through application of the methodology and tools developed by the European Commission for the Efficiency of Justice (CEPEJ) on judicial time management and quality of justice. The quality of judicial statistics is improved as a result of capacity building support to the judicial authorities and pilot courts.
    After having implemented the CEPEJ tools, the clearance rates reach 100% and the disposition time decreases by at least 10% in the pilot courts, against the baseline of the assessment report prepared within the framework of the Eastern Partnership project.

    Quality measures based on CEPEJ tools are implemented in 80% of the beneficiary pilot courts.

    The collection and analysis of judicial statistics for efficient management of courts and policy-making purposes is improved, as confirmed by the data provided for the CEPEJ report on European Judicial Systems.

    The respondents to satisfaction surveys note improvements in the quality of services in the pilot courts (at least a 20%)

    The judicial community is actively engaged in the policy discussions. They support the implementation of measures for improving the efficiency and quality of justice system.
    Expected Result 1.2 An action plan to roll out the results of the pilot phase for increased efficiency and quality of judicial services is developed in dialogue with the judicial and governmental authorities.
    Capacity of the judicial authorities to implement efficiency and quality monitoring of courts is provided through assistance in drawing up relevant procedures and amendments to the legal framework; awareness raising activities and at least two training sessions for the members of the SCM are organised.

    The efficiency of the use of CEPEJ tools in courts is acknowledged and their dissemination nationwide is prepared, based on the lessons learned through the pilot phase.

    The future justice reform measures include actions for dissemination of the CEPEJ tools and guidelines nationwide, based on the lessons learned through the pilot phase.

    The JLC and relevant authorities prioritise improving court efficiency and quality. The judicial authorities have necessary resources (financial or human) to implement further cascading of the results of the pilot courts in other national courts. The judicial community is actively engaged in the policy discussions. They support the MoJ and the JLC in implementation of the measures for improving the efficiency and quality of justice system.
    Expected Result 1.3 The training methodology and curricula for judges (initial and in-service) of the Justice Academy are further improved in line with European standards and good practice, particularly in relation to the application of law and weighing evidence (“judgecraft”), through support to training of trainers (with modern and interactive training methodologies), development of training courses, introduction of new training and evaluation methodologies etc.
    The Justice Academy organises and provides judicial training of high quality, on the basis of comprehensive needs assessments and systematic quality control. The courses are developed on the basis of European principles and an advanced methodology of judicial training.

    Expected Result 1.4 The capacities of the Justice Academy to train judges and court staff on efficient court management and quality of justice in line with European standards are strengthened). The CEPEJ tools and guidelines on efficiency and quality of justice are integrated in the programmes for initial and continuous training of judges and court managers/staff.
    CEPEJ efficiency and quality tools are integrated in the curricula of the Justice Academy.

    The Justice Academy has a pool of trainers on topics related to efficiency and quality of justice, available to further cascade the training within the timeframes of the project implementation and beyond.

    At least 70% of the trainees undergoing the respective training organised in cooperation with the Justice Academy claim to be satisfied or highly satisfied by the training provided.

    Expected Result 1.5 The legal framework concerning the Judicial Legal Council (JLC) and its operational practices are further aligned to CoE standards and specific recommendations.
    Increased compliance of the organisation and functioning of the JLC with European standards.

    The JLC applies these standards and better performs its complex functions for administration of the judicial system, as assessed by CoE monitoring and reports of national and international institutions.

    Judicial authorities maintain the focus on the justice and judicial reform; the authorities have a clear short and long-term goals and strategies for strengthening the compliance with the CoE standards on roles and responsibilities of the judicial self-governing bodies; the capacity building of the JLC can be completed within the timeframe of the project and the necessary financial and other resources are made available for the JLC.

    The involvement of the CoE in the process of improving tne legal framework and operational practices of the JLC is coordinated with the EU and other important donors.
    Project Purpose 2      2015/DG I/JP/3196   Support to the Georgian Bar Association 400 000 
    II.1.3. Improve the quality of the profession of lawyer (advocate):
    - Strengthen the self-governing bodies of lawyers (advocates) including as regards their role in recruitment, training and disciplinary proceedings;
    - Strengthen national training institutions of legal professionals.
    Increased compliance of national legislations and regulations concerning the mandate and functioning of Bar Associations, in corresponding target countries, with European standards and CoE recommendations.
    Training institutions in corresponding target countries put in place a short-term and long-term strategy of development, a developed system of course accreditation, and coherent and comprehensive training programmes with coherent teaching methodology.

    Expected Result 2.1 Increased compliance of national legislations and regulations concerning the mandate and functioning of the Georgian Bar Association (GBA) with European standards and CoE recommendations;
    A set of recommendations towards the reinforcement and clarification of the supervisory functions of the GBA are developed in compliance with European standards and best practices. Up to 80% of them are addressed by the Georgian lawmakers;

    Expected Result 2.3 Increased compliance of the Code of Professional Ethics for Lawyers practicing in Georgia in line with European standards and best practices;
    Ethical procedures for lawyers and application of these procedures are reviewed to identify their compliance with European standards and best practices. By the end of the project, between 70% and 80% of project-produced recommendations based on European standards and best practices on ethical conduct of lawyers are incorporated in the Code of Professional Ethics for Lawyers and practice.

    Expected Result 2.4 Increased legal skills of lawyers through the development of curricula for continuous training courses and the use of the Online Teaching Platform;
    Needs and gaps of continuous professional training courses for the lawyers with regard to legal techniques reasoning, writing, research, and advocacy, court procedure, legal practice and professional ethics are identified and up to 80% of them are addressed by the GBA.

    A viable pool of approved trainers for lawyers is established with the involvement of up to 70% of trainers of the GBA.

    Online Teaching Platform is further developed and updated to comprise all relevant available materials on human rights standards produced by CoE, including HELP Programme.

    Component 1: “Strengthening the efficiency of the judicial system in Ukraine according to the European Commission for the Efficiency of Justice (CEPEJ) tools and methodology”

    Expected Result 3.1 Increased knowledge of key judicial players of the main findings of the EaP 2014 report and more generally of CEPEJ methodology and tools.
    The key aspects of the EaP report and the main CEPEJ instruments necessary for project implementation (SATURN Guidelines on Judicial Time Management, (Handbook for Conducting Satisfaction Surveys, Checklist on the quality of justice and the courts etc.) are translated into Ukrainian and presented to key actors of the judiciary.

    Expected Result 3.2 The length of the proceedings decreases, the clearance rate improves and the disposition time (for certain types of cases) is shortened in pilot courts through the application of the methodology and tools developed by the CEPEJ on judicial time management (e.g. SATURN Guidelines on Judicial Time Management). Quality of judicial services is also improved in pilot courts following the application of relevant CEPEJ tools (Handbook for Conducting Satisfaction Surveys, Checklist on the quality of justice and the courts etc.) Steps are taken to address the shortcomings identified in the pilot programme.
    The court coaching starts in the selected pilot courts which includes a number of awareness raising meetings with the court chairmen, judges and court staff, as well as the meetings for the purpose of establishing degrees of the implementation of the SATURN guidelines and the quality check-list.

    Expected Result 3.3 CEPEJ tools on judicial time management and quality are streamlined in the curricula for initial and continuous training of judges, as well as of court staff such as court managers. A pool of Ukrainian trainers/resource persons on CEPEJ tools is set up with a view to promoting a better knowledge of CEPEJ tools within the Ukrainian judiciary and their further dissemination in Ukrainian courts.
    Judges and court staff including at managerial and operational levels are trained within the framework of the curriculum of the National School of Judges on the CEPEJ tools on judicial time management and quality of justice. The training is carried out by the group of national trainers.

    - the expertise provided to the Working Group moderated by the Presidential Administration is reflected in the amendments to the Law on the Bar and Practice of law;
    - the UBA regulatory framework (including ethical and disciplinary rules) is brought in line with CoE standards;
    - expert revisions of the Code of Ethics are presented to the UBA for consultations.

    Project Purpose 4      2015/DG I/JP/3195   Strengthening the efficiency of justice and support to lawyers’ profession in the Republic of Moldova 1 400 000 
    Component 1: “Strengthening the efficiency of the judicial system in the Republic of Moldova”
    Component 2: “Support to the Moldovan Bar Association (MBA)”:

    Improve the quality of the profession of lawyer (advocate):
    - Strengthen the Moldovan Bar
    Association (MBA) including as regards its role in recruitment, training and disciplinary proceedings;
    - Strengthen national training institution of legal professionals.
    By the end of the project the efficiency and quality of the selected pilot courts are significantly improved which is reflected in the results of the court user satisfaction surveys and assessments of the CEPEJ.


    The MBA is able to represent the interests of its members and to provide a credible counterpart to organisations representing other groups of legal professionals at national level. European standards and the recommendations of relevant CoE bodies concerning the mandate and functioning of Bar Associations are addressed and applied in the Republic of Moldova.

    The quality of the judges/lawyers training is enhanced, applying systematic course accreditation and modern technologies

    Political stability in the country. No significant reshuffling of high level officials and responsible state asnd judicial bodies occurs during the implementation period. The authorities maintain the focus on the implementation of the CoE Action Plan and other country strategic documents with regard to the justice reform; the reform will continue and the means necessary for their implementation will be maintained. 
    Expected Result 4.1 The capacity of the Superior Council of Magistracy (SCM) and other national authorities in assessing the efficiency of the justice system is strengthened.
    Capacity of the judicial authorities to implement efficiency and quality monitoring of courts is provided through assistance in drawing up relevant procedures and amendments to the legal framework; awareness raising activities and at least two training sessions for the members of the SCM are organised.

    Expected Result 4.3 An action plan for the dissemination of the results of the pilot phase, as well as for the preparation and adoption of relevant legislative and policy norms for efficient court work are drawn up and approved by judicial and governmental authorities.
    The next justice reform strategy and action plan include the action plan for the dissemination of the CEPEJ tools and guidelines nationwide, based on the lessons learned through the pilot phase.

The judicial authorities have necessary resources (financial or human) to implement further cascading of the results of the pilot courts in other courts of the Republic of Moldova. Judicial community is actively engaged in the policy discussions. They support the SCM and other authorities in implementation of the measures for improving the efficiency and quality of justice system.
    Expected Result 4.4 NIJ uses the CEPEJ tools and guidelines on efficiency and quality of justice in their initial and continuous trainings for judges.

    Teaching on the CEPEJ tools and guidelines becomes integral part of the curriculum of the NIJ.

    ToT module is developed for the trainers and the NIJ has a pool of the trainers available to furtehr cascade the training within the timeframes of the project implementation.

    At least 70 % of the future trainers of the NIJ claim to be satisfied or highly satisfied by the training provided.
